CIK Issues Proclamation Against Two Absconders in Terror Case in Kupwara

Srinagar, April 29: Counter Intelligence Kashmir (CIK) has executed proclamation proceedings against two absconding accused in a terror-linked case registered under FIR No. 04/1995 at Police Station CIK, officials said on Tuesday.

In a statement issued to Kashmir Convener by the CIK-Kashmir, an official spokesperson said the action was carried out under Section 82 of the Code of Criminal Procedure (CrPC) following orders from the Court of the Principal Sessions Judge Kupwara, who also functions as Special Judge under the NIA Act.

The accused have been identified as Mutwali Poswal, a resident of Kanihehak, Batpora, Kupwara, and Gh Rasool Shah alias Rafie Rasool, a resident of Chandigam, Sogam Lolab in Kupwara district.

According to officials, both individuals were found to be evading arrest and deliberately avoiding legal proceedings during the course of investigation. Based on the evidence presented, the court initiated proclamation proceedings, directing the accused to appear before it within a specified timeframe.

In compliance with the court’s directions, CIK teams carried out the proclamation process at the residences of the accused in their respective localities in Kupwara.

Officials said the accused have been directed to surrender before the court within one month from the date of proclamation. In case of non-compliance, further legal action will be initiated, including attachment of property under Section 83 of the CrPC.

CIK stated that the move is part of ongoing efforts to ensure the presence of absconding accused and to advance investigations in cases involving serious offences.
