Bandipora Legal Services Authority Reaffirms Commitment to Prisoner Rights

UTR Committee reviews 11 cases; directs medical examination and age verification of two prisoners lodged under ULA(P) Act.

 

Bandipora, Oct 24: The District Legal Services Authority (DLSA) Bandipora, under the aegis of the National Legal Services Authority (NALSA) and the Jammu & Kashmir Legal Services Authority, on Thursday held the 4th meeting of the Under Trial Review Committee (UTRC) for District Bandipora.

The meeting aimed to expedite the identification and review of prisoners eligible for release and ensure regular functioning and periodic review of all eligible undertrial prisoners (UTPs) lodged in various jails.

The session was chaired by Principal District & Sessions Judge and Chairman, DLSA Bandipora Khalil Ahmad Choudhary while  District Magistrate Indu Kanwal Chib attended the meeting virtually.

Senior Superintendent of Police Bandipora Aijaz Ahmad Zargar, Secretary DLSA Bandipora Sheikh Babar Hussain, Additional Superintendent of Police Bandipora Ruhail Mircha and Additional District Magistrate Bandipora Zaffar Ahmad Shawal were also present on the occasion.

Other members who joined the meeting included Shahbaz Hussain Shah, DySP Central Jail Srinagar; Gazanfar Syed, Superintendent District Jail Kupwara; Rajinder Singh, Superintendent District Jail Rajouri; and Mr. Khalid Amin, Superintendent District Jail Poonch (through virtual mode). Officials from District Jail Baramulla, the Chief Legal Aid Defence Counsel (LADC), and the Prosecution Department were also present.

During the meeting, the committee reviewed eleven identified UTP cases, of which two cases were taken up for detailed consideration.

After examining the reports from the Superintendent, Central Jail Srinagar, the Committee observed that UTP Abid Ahmad Waza, son of Abdul Gani Waza, resident of Ward No. 5 Bandipora — booked in FIR No. 17/2021 under various sections of ULA(P) Act, Explosives Act, and Arms Act — requires examination by a Standing Medical Board.

The Superintendent, Central Jail Srinagar, has been directed to produce the prisoner before the board and submit a report to the authority.

In another case, the committee reviewed UTP Mohammad Lateef Khatana, son of Raj Wali Khatana, lodged in District Jail Rajouri in connection with FIR No. 80/2019 under ULA(P) Act and relevant RPC sections.

Jail authorities informed that the UTP is over 70 years of age, but no proof of date of birth is currently available. The concerned authorities were directed to obtain and furnish the official date of birth record at the earliest.

The DLSA Bandipora reaffirmed its commitment to ensuring that all eligible undertrial prisoners are periodically reviewed in line with legal provisions and human rights safeguards, thereby promoting justice and reducing unnecessary detention.
