SRINAGAR, October 24: The Jammu and Kashmir High Court has directed that the challan in a mining-related FIR against suspended BJP leader Er. Syed Showkat Gayoor Andrabi shall not be filed without the court’s prior permission until the next date of hearing, subject to objections from the government.

Justice Wasim Sadiq Nargal passed the order on October 21 in CRM(M) No. 863/2026, along with CrlM No. 1976/2026, in a petition seeking quashing of the FIR.
While issuing notice to the respondents, the court permitted the investigating agency to continue its investigation but imposed the restriction on filing the challan.

Petitioner Andrabi was District President of BJP for Pulwama district. Following the registration of FIR, BJP suspended him pending inquiry against him in connection with the FIR registered against him in an extortion case.
Additional Advocate General Alla Ud Din Ganai waived notice on behalf of the government and SHO Pulwama and was granted two weeks to file a reply.

The petitioner was represented by advocates Syed Riyaz Khawar and Tawheed Ali Banday.
Earlier Petitioner alleged differential handling of complaints

According to the petitioner, he had lodged a complaint against Muhammad Yaseen Ganaie, son of Ghulam Muhammad Ganaie, a resident of Sutsoo B, K. Pora, and three other persons, approximately three days before a counter-complaint was filed against him.

The petitioner alleges that his complaint concerned death threats, assault, criminal defamation and an incident in which he was allegedly intercepted behind a dumper.

He has claimed that police directed him to undergo a preliminary inquiry into his complaint, while the counter-complaint lodged a few days later was registered as an FIR without a comparable delay. The petitioner has urged the court to examine the circumstances surrounding the two complaints.

Andrabi has challenged the FIR and sought its quashing, arguing that the allegations require scrutiny in light of the available evidence and applicable law. These are the petitioner’s contentions and have not been established by the court in the order described.
