Court Orders Salary Withholding of Officials in Anantnag Decree Case

Anantnag, April 2: A court in Anantnag has ordered coercive measures against government officials for failing to implement a decree that attained finality in 2018, highlighting prolonged inaction despite repeated directions.

Additional District Judge Anantnag Masrat Roohi, while hearing an execution petition, observed that the decree remained unimplemented since execution proceedings were initiated in 2019.

The court said the continued delay reflected failure on part of the concerned authorities to take concrete steps for compliance, undermining the justice delivery system.

The case assumes significance as it underscores judicial concern over delays in execution of court orders, particularly involving public authorities, which can deprive litigants of timely relief.

In its order, the court directed treasury officers to withhold salaries of the judgment debtors, including the Chief Secretary to the Government of Jammu and Kashmir, Chief Medical Officer Anantnag, Block Development Officer Sallar, and Executive Engineer R&B Division Khanabal, until compliance with the decree.

The court also impleaded senior officials, including the Commissioner Secretary Health, Directorate of Health Services Kashmir, Rural Development Department and the Roads and Buildings Department, to ensure accountability in the matter.

Show-cause notices were issued to the newly added officials, seeking explanations for non-compliance.

The matter has been listed for April 24, 2026 for further monitoring of execution.

The court relied on recent directions of the Supreme Court of India, which mandate time-bound execution of decrees, preferably within six months, and stressed that executing courts must ensure effective enforcement without unnecessary delay. [KNT]
