Court quashes detention of Hubbi under PSA

Srinagar, Nov 21, CNS: The Jammu and Kashmir High Court Monday quashed the detention of senior Tehreek-e-Hurriyat leader Dr Ghulam Muhammad Hubbi. Dr Hubbi was arrested on charges of fomenting trouble in Central Kashmir and under draconian Public Safety Act he was shifted to Kot Balwal Jail in August this year.

     A bench of Justice Muzaffar Hussain Attar while quashing detention order against the detainee issued by District Magistrate Budgam, directed the government to release Hubbi forthwith from preventive detention.

     In the detention order, District Magistrate Budgam had directed Hubbi’s detention in Central Jail, Kote Bhalwal Jammu for the period determined by the advisory board. The detainee’s family according ot CNS had approached the court, challenging the detention order.

    Deputy Advocate General G.M.Reshi who appeared for the state, opposed the plea, however, Advocate Javaid Muhammad Hubbi who represented the detainee maintained the grounds of detention are not only imaginary but the charges leveled against the victim are frivolous.

    While underlining personal liberty was paramount because ‘Right to personal liberty’ recognized by Article 21 of the constitution of India”, the Court quashed the PSA and directed government to release Dr Ghulam Muhammad Hubbi. (CNS)
