Srinagar: The local court here on Monday suggested Jammu and Kashmir government to remove Hamidullah Dar- Food Analyst Kashmir from present assignment and declare him as deadwood.
Chief Judicial Magistrate Budgam, CJM Imtiyaz Ahmad Lone, imposed a fine of rupees nine lacs on Khyber Agro Farms Pvt Limited and 06 months of imprisonment to the accused company through nominated officer.
CJM said this after observing that Dar gave clean chit to the company many times. It was stated that Zeenat Ayoub Food Safety Officer Budgam had sent one of the samples to Food Analyst Srinagar but he certified that he sample of tonned milk is legal and confirmed the parameters indicated in the analytical report. However, the same sample was found sub standard when sent to Referral laboratory Kolkatta.
On this court said either Hamidullah Dar is incapable to conduct the test and discharge his duties to the expectations of his assignment or job or he is dishonest to his job. “In both circumstances the need of the time is to remove the person from the present assignment and initiate the process against him to declare him deadwood”. In a 15 page judgement, CJM termed Hamidullah Dar more dangerous than fatal disease like cancer for the entire nation. He said incapacity or compromise with the nature of job like Food Analyst Kashmir cannot be accepted by any standards of expectations where citizens are involved.
CJM expressed pain in judgement to describe how society has been subjugated to silent injury by permitting convicted company to earn profit at the costs of the lives of the nation only God knows how many people might have died by consuming detergents in the Khyber Tonned Milk.

Court extended appreciation to Zeenat Ayoub- Food Safety Officer who according to the court remained attached with the proceedings and has followed the case with honesty. “Such officers are required for the society and needs to be appreciated,” court said.

The judge also directed Commissioner Food Safety to initiate inquiry against witness Zahoor Ahmad who according to court remained inclined to negate the proceedings initiated by the FSO Budgam and has extended all support to the accused
