Srinagar, Feb 08: A local court Monday sentenced a person to five year imprisonment and fine of Rs 50,000 for sodomizing a teenager, thirty-eight years ago.
Nazir Ahmad Ganaie, the accused person was found guilty of the offence under section 377 RPC for sodomizing a 14-year old boy in 1978.
On the day of incident, the convict compelled the child to have liquor and then forcibly took the victim to an isolated place and made attempts to sodomize the child and get it photographed with an intention to blackmail the victim thereafter. Court said the offence was committed in a well planned manner which has the effect of causing psychological impact on the victim. The Assistant Public Prosecutor pleading on behalf of victim prayed for severe punishment to the accused for such a cruel act.
Counsel for the convict pleaded that he is in his sixties now having his own grand children and as such if he is sentenced to imprisonment it may cause great hardship to him in the society.
Additional Sessions Judge, Srinagar, S R Gandhi after hearing both the parties said in the considered opinion of the court, a sentence lesser than as prescribed for the offence could serve the ends of justice.
Judge said Ganaie shall under undergo imprisonment for five years for the commission of offence under section 377 (read with section 511 of the RPC) and a fine of Rs. 50,000. Court also sentenced him to six month imprisonment for the offence under section 120-B of the RPC. Both the sentences shall run concurrently. The fine shall be paid to the victim as compensation.
As the convict has already gone nine-month imprisonment in the year 1978, court said the period of detention shall be waives off from the substantive sentence awarded to him.
