Directs Municipality to demolish illegal structure on state land
Baramulla, Nov 22, CNS: Overturning the ruling of Sub-Judge Pattan, the Jammu and Kashmir High Court has directed Municipal Committee to dismantle illegal structures being raised on state land in Pattan town of North Kashmir’s Baramulla district.
Some members of Ziyarat Shareef Committee Pattan in violation of Municipal Committee orders had dumped material on the state land and were raising shopping complex claiming that income generated from it would be used for the welfare of the shrine.
Though Municipal Committee Pattan had raised objections, but the members of the shrine approached Sub-Judge Pattan who after submissions from the Shrine members had allowed them to go for construction of the shops on the state land.
Locals who used this state land as parking slot approach High Court and on its directions, Administrative Judge Baramulla Justice Ali Muhammad Magray over ruled the directions of the Sub-Judge Pattan and asked Municipal Committee Pattan to dismantle structures and clear the state land from construction material.
The court of Justice Ali Muhammad Magray gave his verdict in the light of
Article 227 of the Constitution of India read with Section 104 of the Constitution of Jammu and Kashmir.
Meanwhile, locals from Pattan hailed the verdict of court. (CNS)
