Violation of Master Plan HC issued notices to IGP Kashmir, DC Srinagar

Srinagar, January 13: Kashmir High Court has taken serious note of the construction raised in violation to court orders around Dal lake and asked Inspector General of Police Kashmir and Deputy Commissioner Srinagar to explain their position.
A Bench of Justice Husnain Masoodi and Justice Ali Mohammad Magrey issued notice IGP Kashmir after Court vigilance commissioner revealed that JK Police had constructed a hut at Police Golf Course in violation of court orders and master plan.
Court observed that even if the hut has been demolished, still IGP Kashmir needs to explain circumstances in which hut was constructed, oblivious, to court directions and mandate of Control of Building Operation Act and Regulations.
The court also directed to seal a house being raised in Barji Harwan without permission and that too on state land. The bench also asked Deputy Commissioner Srinagar and Tehsildar concerned to explain how the construction was permitted and what action has been taken against erring officials and whether responsibility has been fixed or not.
During hearing of the PIL, it was observed that SMC too have raised structure in front of Harwan Garden on State Land and that too without permission from LAWDA and in violation of court directions. Court issued notice to SMC Commissioner and asked him to explain his position regarding the same.
Court directed SMC to seal the structure and issued notices to erring officers who according to court exhibited negligence in discharge of their duty. Bench asked SMC to report about the action taken against the erring officers by next date of hearing.
